Welcome to CertFactory (“Company”, “we”, “our”, or “us”). By accessing, registering for, or using our web application, practice exam engine, domain diagnostics, and associated services (collectively, the “Service”), you signify your explicit agreement to be bound by these Terms of Service (“Terms”). If you are entering into these Terms on behalf of a corporate entity, educational institution, or other legal organization, you represent that you possess the full legal authority to bind such entity. If you do not agree to every provision of these Terms, you must cease all use of the Service immediately.
2. User License & Restrictions
Subject to your strict compliance with these Terms and any applicable subscription fees, CertFactory grants you a limited, non-exclusive, non-transferable, revocable license to access and use our simulation platform for your personal or internal professional certification preparation.
Prohibited Conduct & Restrictions:
- No Scraping or Harvesting: You shall not utilize web scrapers, automated bots, spiders, scripts, or any data extraction software to harvest questions, rationales, metadata, or user interfaces from CertFactory.
- No Account Sharing: User accounts are strictly personal. Sharing login credentials, selling account access, or allowing concurrent multi-user logins violates these Terms and will result in immediate account termination without refund.
- No Reverse Engineering: You agree not to decompile, reverse engineer, disassemble, or attempt to derive the source code or underlying architecture of our quiz engine and analytics infrastructure.
- No Commercial Redistribution: You may not republish, bundle, sublicense, or commercially distribute CertFactory mock exam content in any format or medium.
3. Intellectual Property Rights
All software, algorithms, user interface designs, custom rationales, domain breakdown graphs, text, graphics, logos, and trademarks appearing on CertFactory are the exclusive intellectual property of CertFactory and its licensors. CompTIA, AWS, Microsoft, Cisco, ISACA, and other certification vendor names and trademarks are the property of their respective holders. CertFactory is an independent preparation platform and is not officially endorsed by or affiliated with any certification vendor. Nothing in these Terms grants you any right to use vendor trademarks or CertFactory brand assets without prior written consent.
4. Disclaimer of Warranties (“AS-IS” Basis)

The service is provided on an “AS-IS” and “AS-AVAILABLE” basis, without warranties of any kind, whether express or implied. To the maximum extent permitted under applicable law, CertFactory disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that practice exam scores will correlate directly with official exam results, nor do we warrant that the platform will be uninterrupted, secure, or free of errors.
5. Limitation of Liability
To the fullest extent permitted by law, CertFactory, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages—including loss of profits, data, use, goodwill, or other intangible losses—resulting from (i) your access to or use of (or inability to access or use) the service; (ii) any conduct or content of any third party on the service; or (iii) unauthorized access, use, or alteration of your transmissions or account data, whether based on warranty, contract, tort (including negligence), or any other legal theory.
6. Indemnification
You agree to defend, indemnify, and hold harmless CertFactory and its licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your misuse of the Service, including your unauthorized sharing of account credentials or scraped materials.
7. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Delaware, and you hereby consent to the personal jurisdiction of such courts.
8. Dispute Resolution & Arbitration
Any dispute, controversy, or claim arising out of or relating to these Terms, including their formation or breach, shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its commercial arbitration rules. The place of arbitration shall be Wilmington, Delaware. You agree that any arbitration shall be conducted on an individual basis and not in a class, consolidated, or representative action.
